Durable Powers of Attorney are powerful documents that allow for designated persons to manage your financial affairs.  A Durable Power of Attorney provides your agent with the power to step into your shoes and do anything with your assets that you can do yourself.

The Power of Attorney can be general or it can be limited to a specific transaction, and it is structured to take effect immediately.

If you become incapacitated and have not designated a Power of Attorney, then Florida law will provide one for you through a guardianship proceeding, and the court appointed guardian may not be the person you would have chosen for yourself.  A Durable Power of Attorney can help to protect you from the expense and hassle associated with a guardianship proceeding.
